TÜM HUKUKÇULARA ÇAĞRI KAMPANYASI GİDEREK BÜYÜYOR. (Joın the invitation to all the jurists campaign.)
05.05.2003, 13:27 Benim amacım, hiçbir kurum ve kuruluşu bağlamadan hukukçu arkadaşların kişisel olarak değindiğim konular üzerine uluslararası mahkemelere dava açılmasını sağlamaktır. Böylelikle Irakta uluslararası hukuk kuralları çiğnenerek yapılan olaylara duyulan tepkiler dilek ve temennilerden öteye somut bir boyut kazanmış olacaktır.

Dünyadaki bütün hukukçulara hitaben yapmış olduğum kampanya giderek büyüyor. Özelikle Avrupa da ilgi gören bu kampanyaya Türkiyeden de katılımın olmasını diliyorum. Bu bağlamda Türk Hukukçularının da konuya hassasiyet göstermelerini ve destek olmalarını bekliyorum. Benim amacım, hiçbir kurum ve kuruluşu bağlamadan hukukçu arkadaşların kişisel olarak değindiğim konular üzerine uluslararası mahkemelere dava açılmasını sağlamaktır. Böylelikle Irakta uluslararası hukuk kuralları çiğnenerek yapılan olaylara duyulan tepkiler dilek ve temennilerden öteye somut bir boyut kazanmış olacaktır.

Baro Merkezleri, bünyesine bağlı avukatlardan birine gönüllü olarak bu konuda şahsi dava açtırsa üzerimize düşen görevi fazlasıyla yerine getirmiş oluruz.

Bunun için sizlere başta Türkiye de olmak üzere çeşitli ülkelere ait baro merkezlerinin email adreslerini ilişikte sunuyorum. Sizlerden bu adreslere bu metni göndererek hukukçu arkadaşları harekete geçirmenizi bekliyorum ve sizlere güveniyorum.

Uluslararası hukuk kuralları çiğnenerek yapılan Irak savaşı sona erdi. Haklı yada haksız yapılmış olan bu savaşın yanlışları biran önce temizlenmeli ve yaraları sarılmak zorunda!

Ayrıca, savaşta ölen yada ağır şekilde yaralanan çocuklar, siviller, hamile kadınlar ve bunların yakınları, acılarının taze ve Irakta hayatın henüz normale dönmemiş olması nedeniyle haklarını aramak üzere uluslararası mahkemelere müracaat edememektedirler.

Gerekli uluslararası hukuki işlem yapıldığı takdirde, Amerika’nın uluslararası hukuk kurallarını çiğneyerek yapmış olduğu Irak savaşı ile zedelenen uluslararası hukukun itibarı dünya kamuoyunun gözünde biraz olsun geri gelecektir. Burada bütün amacım, zedelenen uluslararası hukukun itibarının geri gelmesidir. Unutmamalıdır ki hukuk dışı davranışlar zorbalığı ve kaosu doğurur.

Bu durum göz önüne alınarak mağdur olan bu kişilerin haklarının aranması ve gerekli tazminatların ödenmesi konusunda bu kişilerin müracaatları gerekmeden ve keza daha önce değinmiş olduğum konularda uluslararası mahkemelerde dava açılması için, bu konuda tecrübesi ve olanakları müsait olan bütün hukukçuları dava açmaya davet ediyorum.

Umarım, taraflar bir Türk olarak uluslararası hukuğun itibarını geri getirmek için sergilemiş olduğum bu çabalarımı anlayışla karşılarlar...

I am waiting for your support of my invitation to all the Lawyers and Judges in the world. My aim is to make the jurists go to law courts about the things which doing this, the reactions about the things happened in Iraq, will not only be hopes and wishes, it will become a concrete dimension, something real.

If with reading or forwarding this email, any of the body of the lawyers gives a duty to any of theirs members, you could start thinking that you did something for the people in Iraq.

Now, I am sending you the addresses below for you to forward them. First of all we must send this email to the body of the lawyers in Turkey or anywhere in the world (Who are trying to do something.) Maybe this little shout will become a loud scream in the world. I believe in all of you.

INVITATION TO ALL JURISTS IN THE WORLD.

The war on Iraq that was waged despite all international rules, has finished. Now it’s time to correct all the errors and to heal all the injuries no matter if the war was right or wrong.

The conflicting sides of the war must be investigated, as to if they obeyed or not obeyed international rules of war, or if they have commited war crimes, this before proofs disappear. And if so suspected, they must be brought to answer before international courts of justice.

As to this war, first of all it must be established wheather the U.S.A. or the U.K. used cluster bombs against Iraqian civilians. If so, the ones who used that type of bombs must be punished.

Besides, who accounts for all the dead or heavily injured people? How can we expect that widows, pregnant women, children or dependents of these people, should apply to the internationl courts? The war has newly stopped and everything is still a matter of life or death. Life is desperate and irregular, there is nowhere to go, nowhere to eat, nowhere to sleep. And also there is nowhere to turn in an application to a court.

At this moment it is urgent, that the esteem for and honour of international law should return in the eyes of the world public opinion, after being severely damaged because of the war waged against Iraq by U.S.A. and U.K.

My only aim is to help bring back the esteem for and honour of law. Let us never forget that, illegal acts cause chaos and despotism.

With these points of view, I am inviting all the lawyers who feel the same and are disposed to work, contribute their time and experience to rectify this situation to join in an effort to help all the people who were injured directly or indirectly. We have to try to bring back the rights of these people to apply to international law courts in order to create justice for all who suffered injustly terrible damages.

I hope, the sides would be tolerant to a Turkish citizen’s efforts in bringing back the esteem for and honour of international law.
